Thank you for your question! Do not leave the U.S. without the Advance Parole! If you leave the U.S with a pending I-485, without an Advance Parole document, your I-485 application will be considered abandoned and you'll have to start a new application. (It does not matter that you have a valid visa) You could expedite your I-131 if the reason you are leaving the U.S is critical, but that option requires careful planning and building your case. If he's been paying taxes and working a 9 to 5, he has a residency and has legal dependents. Dudes paperwork should be pushed forward. We pay for housing for illegals. Why can't the guy who stayed legally and contributed to society come back? If they make it a problem, he might as well cross the border illegally. At least he wouldn't have to worry about his dad being homeless.

The child had been with the couple for nearly five years….and to her, they were her whole world. They provided a nurturing, safe, and joyful environment…far removed from the impoverished and unsafe conditions of her birthplace. Had she been torn from the only family she knows and sent back to Guatemala, the impact would have been devastating. It would have meant stripping her of her security and thrusting her into a world of strangers. Recognizing the severe emotional trauma this could cause, the U.S. authorities decided against the relocation (which was the right move). Though the situation is complex and fraught with challenges, the child’s well being is best maintained with her adoptive parents.
